Read the clause about who pays before you read the price. Termite agreements in North Carolina come in three kinds, and the difference between two of them is the difference between a company returning to treat and a company paying to replace a joist. Most people find out which one they signed at the worst possible moment.

Re-treatment only, the common one

A re-treatment only agreement means additional treatment if termites are found during the agreement period. That is the whole obligation. There is no duty to repair anything, and most such agreements run for one year following the initial treatment, with renewal after that. It is the most common practice in the industry, which is precisely why it deserves naming out loud.

It is not a bad product. Re-treatment is what stops an active infestation, and for a house with no damage that is the sensible thing to buy. It simply does not do what a lot of buyers assume it does.

Re-treatment and damage repair

The second type obligates the company to repair, replace or correct damage up to a stated amount, for damage occurring after the initial treatment. Two conditions attach in practice. Not all companies offer it, and the structure typically has to meet certain criteria to qualify, which is where conducive conditions and access come back into the conversation.

Read the stated amount and the start date carefully. Damage predating the initial treatment is not covered by anybody, and a limit that sounded generous at signing may not go far against a floor system.

The third kind, which is no warranty at all

An agreement may come with no guarantee or warranty, and where that is the case the absence has to be clearly indicated in the agreement. That is a legitimate option, often on a one-off treatment. It only becomes a problem when the buyer believed otherwise, which is why the rules require it be spelled out rather than left silent.

What a warranty is not

A warranty is not an assurance that termites will not return. It provides for corrective action as specified, and nothing more. Anyone presenting one as protection against the insects rather than as a defined remedy is describing something that does not exist. The question worth asking is always what exactly happens, and who pays for what, when activity is found again.

Homeowners insurance will not fill the gap

Standard homeowners policies exclude termite damage, on the basis that it accumulates gradually rather than happening as a sudden accidental event. So the joist is not an insurance question, and the space between a re-treatment only agreement and the real cost of carpentry lands on the owner. Read your own policy language rather than take this as certainty about your particular policy, but do not plan around a claim.

That is the practical reason the agreement type deserves five minutes of attention. It is the only document that might pay for repairs.

What to check on the paper in front of you

Any agreement for the control or prevention of wood-destroying organisms in this state must be in writing and must carry the license number and phase of the licensee with the full company name, a foundation diagram marked active or inactive, the location of visibly damaged timbers on that diagram, whether re-inspections happen and roughly how often, the circumstances in which a re-treatment will be carried out, and the total price for the treatment service. If re-treatment is owed, the obligation runs within thirty days of written notice, so give notice in writing and keep the copy. A seller with a wood-destroying insect report in progress should also remember that where treatment is done, the written agreement and warranty get attached to that report.
